Simon Pearce's Summer Tablescape Contest Rules 

Sponsored by: Simon Pearce (U.S.), Inc., 109 Park Road, Windsor, VT, 05089, sometimes referred to herein as Sponsor.

Entry period: The "Simon Pearce Summer Tablescape" Contest (the "Contest") begins at 8 a.m. Eastern Standard Time ("EST") on June 17, 2009, and ends at 11:59 p.m. EST July 19, 2009.

Eligibility: No purchase is necessary.  The Contest is open to legal residents of the United States and the District of Columbia who are at least 21 years of age or older as of the date of entry and who have an active e-mail account and Internet access. Employees and their immediate families (spouse, parent, sibling, child, and respective spouses) and those living in their immediate households, whether or not related, of Sponsor and its respective parents, affiliates, and subsidiaries are not eligible to enter or win a prize. Void where otherwise prohibited by law. All applicable federal, state, and local laws and regulations apply.

How to enter: Contestants may enter the Sweepstakes by emailing their Simon Pearce experience/story/image/suggestion to webmaster@simonpearce.com. Entries submitted via any other method will be void. Submissions must include a digital photograph, a description of the the photograph, the name, address, and telephone number of the author. Entry submissions submitted to Simon Pearce prior to the start of the entry period are void unless resubmitted to Simon Pearce with completed entry during the entry period. Entries generated by script, macro, or other automated means are void, and the entrant will be disqualified from winning. Use of any false e-mail account will void all entries made by that entrant. Collection and handling of personally identifiable information will be in accordance with the Privacy Policy as posted on SimonPearce.com. All entries become the property of Simon Pearce and will not be acknowledged or returned. Simon Pearce reserves the right to edit for space, grammar, and clarity.

The entrant must be the original author of the entry. Entry must not have been submitted in any other competition or previously published. Entry must be in keeping with Simon Pearce's image and may not be offensive, as determined by judges in their sole discretion. Simon Pearce reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules.

Prize(s): One winner will be chosen by a panel of qualified judges from all entries received by 11:59 p.m. EST on July 27, 2009. The judges will base their decisions on the following criteria: use of Simon Pearce product in the image, adherence to the theme, beauty, individuality, and creativity. The judges' decisions are final and binding on all matters relating to the Contest.

The winner will be awarded a single pitcher of their choice from the following Simon Pearce pitchers:  Brookfield Pitcher (F0828, F0328), Barre Pitcher (F0366, F0367), Wellesley Pitcher (F0349, F0359), Woodbury Pitcher (F0335, F0345), Windsor Pitcher (F0375), Meriden Pitcher (F0360, F0370), Addison Pitcher (F0364), Woodstock Pitcher (F0395), Stockbridge Pitcher (F0311). No substitutions of prizes are permitted except by Simon Pearce as may be necessary due to unavailability, in which case a prize of equal or greater value will be awarded. All federal, state, and local taxes are the sole responsibility of the winner. Prizes will be awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. Prizes cannot be transferred, substituted, or redeemed for cash, except by Sponsor in its sole discretion. The winning entry will be announced on July 27, 2009 at http://www.simonpearce.com/pontilisms.

Claiming a prize: Winners will be notified via e-mail, within 7 days following selection of the winners, at the e-mail addresses that they provided with their entries. All prizes must be claimed within 7 days. To claim their prize, winners must respond to Simon Pearce's prize notification e-mail and complete the Affidavit and General Release and W-9 form included with such e-mail. All unclaimed prizes will be forfeited and awarded to alternative winners selected from the original pool of eligible entries for the Contest.

General conditions: By participating in the Contest, entrants agree to abide by the terms of these Official Rules and by the decisions of Sponsor and the judges, which will be final and binding on all matters pertaining to this Contest. By submitting an entry form, the entrant is representing and warranting to Sponsor that she/he is an eligible contestant.  Except where prohibited by law, by entering the Contest, each entrant agrees that Sponsor and its designees may use his or her name, likeness, city, and state for advertising, promotional, and other purposes in any media now or hereafter known throughout the world (including the right to post entry on Sponsor's Web sites) without further compensation or notification. Neither Sponsor, nor its parent, affiliates, subsidiaries, divisions, advertising, and promotion agencies, or the respective officers, directors, employees, or agents of the foregoing (collectively, the "Released Parties") are responsible for (i) any injury, losses, or damages of any kind resulting from participation in this Contest or acceptance, possession or use of the any prize; or (ii) any warranty, representation, or guarantee express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness. Each entrant agrees to indemnify, defend and hold harmless Simon Pearce (U.S.), Inc. and its affiliates, subsidiaries, officers, directors, representatives, agents, and employees from any and all liability whatsoever for any injuries, losses, or damages of any kind arising from or in connection with, either directly or indirectly: (1) the entrant’s breach of any representation or warranty contained herein, (2) acceptance, receipt, possession, use, and/or misuse of any prize awarded herein; (3) any copyright or other intellectual property violation or infringement, or (4) participation in the Contest. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the Contest, and judge entries from among all eligible, nonsuspect entries received prior to such action. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SIMON PEARCE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

Entry rights: By submitting an entry, each entrant agrees Sponsor shall own the Entry submitted (including all rights embodied therein) and that it and its designees may exploit all elements of such entry in any and all media now known or not currently known (including the right to post Entry on Sponsor's Web site), without compensation to entrant or any third party and without limitation to time or territory. The Sponsor reserves all rights, including the right to edit, publish, use, adapt, exploit, modify, copy, disseminate, post, or dispose of any Entry, online, in print, film, television, or in any other media for advertising and promotional or other purposes without compensation or notification to the entrant of any kind, except as prohibited by law.

Privacy: By entering this Contest, you agree and consent that any information you provide upon entering may be used by Sponsor in accordance with its Privacy Policy, available at http://www.simonpearce.com/CSTM_PrivacyPolicy.aspx. If you do not want your information used in this manner, do not enter this Contest.

Governing Law:  This Contest shall be interpreted and governed by the laws of the State of Vermont and any applicable laws and regulations of the United States.  The entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively, before a state or federal court located in Chittenden County, Vermont having competent jurisdiction, which Court shall apply the laws of the State of Vermont without regard to any principles of conflicts of laws, and submission of said entry constitutes acceptance of such laws.  The entrant further agrees that no claims, judgments or awards shall exceed the amount of the Contest prize and under no circumstances shall include attorney’s fees; nor shall any entrant be permitted to obtain awards for punitive, incidental, consequential, or other similar damages or have any damage awards multiplied or increased for any reason.
